Thank you very much for choosing KONDOR PATH TOURS S.A.C., direct operator of the Historic Sanctuary of Machu Picchu, The Network of Inca Trails, alternative hiking circuits, outdoor activities, etc., for your next vacation.

Please read the information carefully in this article, which contains the TERMS AND CONDITIONS FOR CONTRACTING TOURIST SERVICES with our company.

Booking Procedures

Please read our terms and conditions once you have chosen your program, as your reservation is subject to the terms listed below. A contract is entered into once KONDOR PATH TOURS receives your reservation and deposit form, and we accept and confirm the reservation. Please note that travel arrangements are not guaranteed until stated so in writing by Kondor Path Tours S.A.C.

Deposits 

PayPal allows you to make payments using various methods, including PayPal balance, a bank account, PayPal-Credit, debit or credit cards, and rewards balance. You can use most major credit cards on PayPal, including Visa, MasterCard, Discover, American Express, etc. You can also link debit cards with Visa or MasterCard logos to your PayPal account. If you do not have a PayPal account, you can open it in seconds with your email or make payments directly with your bank card using the PayPal system. Note: The traveler pays an additional 6% fee using the PayPal system in Peru and South America.

  • Tour packages & Multi-Day Hikes for more than two days:
    • First Payment: 35% by the time of booking. 
    • Second Payment: Full Amount paid 30 days before your arrival.
  • Day tours & day hikes; 100 percent payment.
  • If you are booking a complete itinerary, including hotels, with Kondor Path Tours PERU, we will request 50% of the total value as a deposit.
  • We require 100% of the total Tour/Trek equivalent for last-minute Bookings.

Inca Trail NoteThe camps may vary due to the anticipated time of Inca Trail reservations and availability, weather conditions, or restrictions undertaken for safety reasons by the Peruvian Government.

Final Payment Terms

What will you pay your final balance 30 days before your arrival via PayPal? We accept payments through PayPal that will incur a 6% merchant fee paid by the traveler

  1. What must notify Kondor Path Tours of any change or cancellation of your trip as soon as you become aware of them by email?
  2. The initial deposit sent for is Non-Refundable nor transferable to any other date, person, or tour (according to Inca Trail and Machu Picchu Regulations).
  3. There will be parts of your trip that you can use (Machu Picchu entrance fee, one train ticket (AGUAS CALIENTES to OLLANTAYTAMBO or POROY), 01 Machu Picchu bus ticket, and one bus ride from OLLANTAYTAMBO or POROY  to CUSCO).
  4. We can also provide a claim letter for your insurance company upon request.

Cancellation Policy for Machu Picchu, Alternatives Treks & Tours 

The client is responsible for any fees or charges incurred by the cancellation (Percentage of the total package price).

NO SHOWS: If clients do not show up for the tourist circuit or decide not to continue on the tourist excursion for X reasons, no refund will be made, considering NO SHOW.

🙂 Machu Picchu regulations. About the entrance tickets to Machu Picchu, the deposit sent is not refundable or transferable to any other date, person, or tourist circuit “the Government of Peru manages and controls Machu Picchu tickets.” So make sure your name and passport number are correct. If you change your passport after booking Machu Picchu or plan to travel with a different Passport, you MUST also bring the passport you used to secure your permit, or you will not be able to enter Machu Picchu.

Insurance

We also recommend a short-term traveler’s insurance policy covering accidents, baggage loss, emergency evacuation, etc. Any expenses resulting from flight delays, schedule changes, missed connections, illness, and travel delays due to bad weather, trail conditions, strikes, natural disasters, cancellations, or acts of God will do borne by the passenger through the traveler’s insurance. We will help you obtain all the documentation (when possible) to file a claim with your insurance company.

Accommodations

HOTEL: You are responsible for any damage caused to your accommodation or its contents during your stay; you must cover these charges, and you may have to pay them locally. We reserve the right to offer alternative accommodation of a similar standard if it is beyond our control “availability.” What will make no changes after payment? All accommodations within Peru will require you to show your passport with the Peruvian migration card to create a photocopy of it (government requirement and taxes).

The client intends by the waiver agreement to release Kondor Path Tours and hold it harmless from all liability, whether based upon Hotel for services rendered.

TRAIN TIMES for tours & treks

In high season the trains become fully booked, so we might have to reserve the Inca Rail or Peru Rail train service “subject to availability.” We don’t control seat assignments entirely at the Rail Companies’ discretion.

Train Advise
Luggage Policies and Identity Requirements by Inca Rail & Peru Rail changed its policies regarding luggage: 01 bags or backpack must not exceed 5 kg/11 pounds or 62 inches/157 cm (length + height + width). This means you should bring along a small backpack to Machu Picchu. You can leave your main luggage at your Hotel (Cusco).

The Train service will require that each passenger boarding a train service submit their train ticket + original passport. Without this, The passenger will not be able to board the train for safety of the passengers.

Increments in Case of Protests, Strikes

If a protest/strike is not uncommon in Cusco, it may be necessary to leave a day or two days ahead of schedule to fulfill our services.

Holidays: An increment of $45 per person is applicable for all treks (regardless of group / private option/size of group) leaving during these holidays: Christmas (Dec 22nd, 23rd, 24th, 25th), New Year (Dec 29th, 30th, 31st, Jan 1st). We use the increments to pay staff a bonus for leaving on their vacation or used to pay for the Peruvian election tickets.

Images & Marketing

  • While participating in any Tour/Trek, you agree that the Tour Operator or its representatives may take images, photos, or videos.
  • You consent to take such photographs and grant a perpetual, royalty-free, worldwide, irrevocable license to Kondor Path Tour Operator. Reproduce for any marketing purpose, creating promotional materials in any medium, whether currently known or developed from now on, without any additional obligation or compensation payable to you.

 

DISCLAIMER OF LIABILITY ADVENTURE ACTIVITIES

Please read carefully

In consideration of the services of Kondor Path Tours S.A.C., and its owners, directors, employees, agents, contractors, representatives, successors and assigns, and all other persons or entities associated with that business (from now on collectively referred to as “THE TOUR OPERATORS”), I agree to the following release.

In this release, the term “adventure activities” shall cover all activities, events, or services provided, arranged, or organized by THE TOUR OPERATORS, including but not limited to orientation and training sessions, land or air transportation, including travel helicopter, loading, unloading, and transport ships and aircraft or movements around them, long walks, backpacking trips, cookouts, fishing, climbing, mountaineering, mountain biking, caving, glaciers walks and others trekking activities, as well as other activities, events, and services related in any way with these activities.

I fully understand that adventure activities, whether in civilized or remote areas and by ship, aircraft, boat, bicycle, foot, horseback, or any other form of transportation or travel, contain an inherent risk of illness and injury to property and person and death. These risks may result from the nature of the activity itself, the negligence of others, defects in equipment supplied by THE TOUR OPERATORS, the use and operation of such equipment, weather, road and trail conditions, my physical condition, first-aid and emergency treatment, and lack thereof, and consumption of food and drink. I am participating in adventure activities.

I am aware of the risk and dangers inherent in the activities arranged by THE TOUR OPERATORS that I and my family, if applicable, are involved in. I am mentally and physically capable of participating in the activities and willingly assume the risk of injury, loss, or damage to property or death as my sole responsibility.

I understand that THE TOUR OPERATORS reserves the right to take photographic or film records of their trips. I now agree that they may use such photographic or film records for promotional and commercial purposes.

As lawful considerations for being permitted by THE TOUR OPERATORS to participate in the adventure activities or others undersigned at this moment releases. THE TOUR OPERATORS from any liability, claims, demands, actions, or rights of action for any illness, injury, death, or damage to myself and my property. These are related to or are connected with my participation in scheduled or unscheduled activities arranged by THE TOUR OPERATORS. This release includes but is not limited to the negligent act or omissions of THE TOURS OPERATORS but excludes grossly negligent actions of THE TOUR OPERATORS.

I agree that the preceding obligations shall be binding on me and upon my heirs, assigns, and family members, including any minors accompanying me.

Further, on behalf of my heirs, more nearby relatives, administrative, testamentary executors, and representatives, in case of my death or incapacity. I promise & covenant not to sue, assert, or otherwise maintain any claim against THE TOUR OPERATORS for any injury, death, or damage to myself or my property arising from or in any way connected with my participation in any activity arranged by THE TOUR OPERATOR.

IN SIGNING THIS DOCUMENT, I RECOGNIZE THAT IF ANYONE IS HURT OR PROPERTY IS DAMAGED WHILE I AM PARTICIPATING IN ANY ACTIVITY ON THIS TRIP, I WILL HAVE NO RIGHT TO MAKE A CLAIM OR FILE A LAWSUIT AGAINST THE TOUR OPERATORS. NEGLIGENTLY CAUSES BODILY INJURY OR PROPERTY DAMAGE, EXCEPT IF THE TOUR OPERATOR does found TO BE GROSSLY NEGLIGENT.

I understand that this writing is the entire, integrated agreement between myself and THE TOUR OPERATORS and that it can only be modified or changed by a writing signed by both parties. I expressly agree that this release does intend to be as broad & inclusive as the laws of the country of Peru allow. If any portion hereof is later found invalid or not enforceable, the balance of this release shall continue in full legal force and effect.

By accepting this release, I am not relying on my promise or oral or written representations made by THE TOUR OPERATORS regarding the safety of adventure activities other than as provided in this release.

I HAVE CAREFULLY READ THIS RELEASE. I FULLY UNDERSTAND AND AGREE TO ITS CONTENTS AND SIGN OF MY OWN FREE WILL.
